Culver Franchising System, LLC Do Not Call Policy
Introduction
Culver Franchising System, LLC (“Culver’s”) respects the privacy of consumers and is committed to complying with rules governing telemarketing activities, including the Telephone Consumer Protection Act of 1991 (TCPA) and the Federal Trade Commission’s Telemarketing Sales Rule (TSR). These rules require companies to:
- Maintain a written Do Not Call policy, available to consumers promptly upon request;
- Train all personnel engaged in any aspect of telemarketing on the existence and use of the Do Not Call policy and list;
- Record do-not call requests at the time the request is made, and honor a consumer’s request to have their telephone number placed on the Do Not Call list within thirty days of such request;
- When making a telemarketing call, provide the called party with the name of the individual caller, the name of the entity on whose behalf the call is being made, and a telephone number or address at which the entity may be contacted, which may not be a 900 number or any other number for which charges exceed local or long-distance transmission charges;
- Honor the do-not-call request for the particular business entity making the call, and not for affiliated entities unless the consumer would reasonably expect them to be included under the circumstances;
- Maintain a company Do Not Call list, and honor requests for five years from the time the request is made;
- “Scrub” telemarketing lists against the National Do Not Call Registry at least once per month; and
- Only make calls between the hours of 8 a.m. (9 a.m. Sundays), and 9 p.m., local time, unless there is prior consent from the person being called.
Telemarketing
Culver’s does not make telemarketing calls to consumers.
Short Message Service (SMS or Text) Marketing
Culver’s sends SMS marketing messages only to Delicious Rewards members who have affirmatively consented through a dual opt-in process to receive such SMS marketing messages. Culver’s honors requests to stop or opt out of SMS marketing within ten business days of the request, and typically within 24 hours of receipt of the request.
Do Not Call List
Culver’s maintains a list of customers who have opted out of SMS marketing. This is Culver’s internal Do Not Call List, which is accessible to and utilized by our Customer Service, Marketing Analytics and SMS Marketing teams. Any person who informs us that they do not want to receive marketing calls or SMS messages from us will be placed on our Internal Do Not Call List within ten business days of making the request, and typically within 24 hours of receipt of the request. Telephone numbers will remain on our internal Do Not Call List indefinitely unless the customer once again requests and affirmatively opts in to receive SMS marketing messages.
Training
Culver’s is committed to informing, training, and reinforcing this Do Not Call Policy with all employees involved in SMS marketing and opt-out procedures, and will continuously monitor compliance requirements throughout our marketing efforts. Employees involved with activities affected by this Do Not Call Policy receive training to enable them to take actions consistent with this Do Not Call Policy.
Do Not Call Policy Requests
